NYC Angels Grab Market Share

detail_crunchbase 2Looking forward to this week’s Disrupt NY 2013, we used the CrunchBase dataset to surface regional trends in US angel funding. ?Not surprisingly, we found?relatively few metros with a substantial number of angel funded?companies and?the San Francisco Bay Area continues to be a formidable presence. ?But take a look at NYC (in red) – they’ve gone from 12% of the angel deals in 2008 to 20% in 2013. ?In fact, NYC appears to the only region with growing market share. What’s more surprising about NYC’s angel activity is that it is not reflected in its general share of venture rounds. ?When we looked at non-angel investments we found NYC’s share of activity to be relatively flat since 2008. ?It’s not clear to us what’s driving this, but we suspect others will have some good theories and that bring’s us to the data behind the graphs. LOS ANGELES (AP) - Clayton Kershaw retired 18 consecutive batters and struck out 12 in eight dominant innings, Carl Crawford homered twice against Kyle Lohse and the Los Angeles Dodgers beat the Milwaukee Brewers 2-0 on Sunday.

Kershaw (3-2) scattered four hits and didn't walk a batter while lowering his ERA to 1.73. The 2011 Cy Young Award winner, who led the NL in ERA in each of the previous two seasons, hasn't allowed more than three earned runs in any of his last 18 starts - the longest active streak in the majors. The last time he did was July 24, 2012, when he gave up eight at St. Louis.

Kershaw stranded runners in scoring position in each of the first two innings, retiring Jonathan Lucroy on a double-play grounder in the first and striking out Martin Maldonado to end the second. He gave up a leadoff double in the eighth to Carlos Gomez, who tried to advance on a broken-bat comebacker to Kershaw and was tagged out by third baseman Juan Uribe in a rundown.

Kershaw's string of consecutive outs began after Rickie Weeks' bloop double leading off the second.

Milwaukee's only other hits were one-out singles in the first by Jean Segura and Ryan Braun. It was the left-hander's fifth game with at least 12 strikeouts.

Kershaw began the season with 4-0 and 1-0 wins over San Francisco and Pittsburgh, allowing no runs over 16 innings. On opening day, he threw a complete-game four-hitter

Brandon League pitched a perfect ninth inning for his eighth save in nine chances.

Crawford drove Lohse's first pitch of the game over the center field fence. It was the fourth time that the right-hander gave up a home run to his first batter in 336 career starts - and the first one that came on his very first pitch. Crawford's second homer came on an 0-2 count and landed in the right field pavilion. It was his sixth multihomer game in the majors and first since July 8, 2010, for the Tampa Bay Rays against Cleveland's Jake Westbrook.

Lohse (1-2) gave up five hits and no walks while striking out four. The 13-year veteran had allowed only one home run in 25 innings over his first four starts for the Brewers, who signed him to a three-year, $33 million contract as a free agent on March 25.

NOTES: Kershaw threw 117 pitches. The other leadoff homers Lohse has given up were by Jose Valentin (2001), Chuck Knoblauch (2002) and Jayson Werth (2011). ... 3 Taliban bombs target Pakistani politicians

PARACHINAR, Pakistan (AP) ? Taliban bombs targeting politicians in northwestern Pakistan on Sunday killed 11 people, the latest in a series of attacks meant to disrupt next month's parliamentary election, police said.

The wave of political violence has killed at least 60 people in recent weeks, and many of the attacks have been directed at candidates from secular parties opposed to the Taliban. That has raised concern the violence could benefit hard-line Islamic candidates and others who are more sympathetic to the Taliban because they are able to campaign more freely without fear of being of being attacked.

Pakistani Taliban spokesman Ahsanullah Ahsan claimed responsibility for the three attacks, plus two others against secular parties in the southern port city of Karachi on Saturday that killed four people and wounded over 40.

"We are against all politicians who are going to become part of any secular, democratic government," Ahsan told The Associated Press by telephone from an undisclosed location.

The first bomb on Sunday ripped through the campaign office of Syed Noor Akbar on the outskirts of Kohat city, killing six people and wounding 10, police officer Mujtaba Hussain said.

A second bomb targeted the office of another candidate, Nasir Khan Afridi, in the suburbs of Peshawar city. That attack killed three people and wounded 12, police officer Saifur Rehman said.

The politicians were not in their offices at the time of the blasts. They are both running as independent candidates for parliament to represent constituencies in Pakistan's rugged tribal region along the Afghan border, the main sanctuary for Taliban and al-Qaida militants in the country.

Many politicians running in the May 11 election from the tribal region have their offices located elsewhere and find it hard to campaign in their constituencies because of the danger. The two who were attacked Sunday are considered to hold relatively progressive views compared to the deeply conservative Islamic beliefs of many in the tribal region.

The third attack occurred in the town of Swabi, where a bomb went off during a small rally held by the Awami National Party, which has been repeatedly targeted by the Taliban. The blast killed two people and wounded five, said police officer Farooq Khan. The two candidates targeted in the attack, Ameer Rehman and Haji Rehman, were not hurt.

The Pakistani Taliban have been waging a bloody insurgency against the government for years that has killed thousands of civilians and security personnel. The group's goal is to oust Pakistan's democratic government and implement a system based on Islamic law.

In mid-March, the Taliban threatened attacks against three secular parties that have earned the militants' ire by supporting military operations against them in the northwest: the Awami National Party, the Muttahida Quami Movement and the Pakistan People's Party. The Taliban have carried out at least 20 attacks against politicians and campaign workers since then, mostly from these three parties.

The violence has forced the parties to close dozens of campaign offices and has prevented them from holding large political rallies that are normally the hallmark of Pakistani elections. Many of the candidates have had to find ways to campaign from a distance, relying more on social media, advertisements and even short documentaries to rally support.

That has put these candidates at a disadvantage, and many have complained the militant violence amounts to vote rigging.

Candidates from Islamic parties and others who have advocated negotiating peace with the militants rather than fighting them have been able to campaign with much less fear of being attacked.

Former Prime Minister Nawaz Sharif, head of the Pakistan Muslim League-N party, held a rally with several thousand people in the northern town of Murree on Sunday without incident. Many analysts predict Sharif's party will come out on top in the parliamentary election.

The Taliban issued a statement earlier this year requesting that Sharif and the heads of the country's two largest Islamic parties mediate peace negotiations. Sharif declined but said he was a supporter of the talks.

The parties that have been targeted by the Taliban also support peace negotiations with the militants, but only if they lay down their weapons and accept the constitution first ? conditions the militant group has rejected.

Bangladesh Building Collapse: Fire Breaks Out In Factory Wreckage

SAVAR, Bangladesh ? The fugitive owner of an illegally constructed building that collapsed and killed at least 377 people was captured Sunday by a commando force as he tried to flee into India. At the disaster site, meanwhile, fire broke out in the wreckage and forced authorities to suspend the search for survivors temporarily.

Mohammed Sohel Rana was arrested in the western Bangladesh border town of Benapole, said Jahangir Kabir Nanak, junior minister for local government. Rana was brought back by helicopter to the capital of Dhaka where he faced charges of negligence.

Rana's capture was announced by loudspeaker at the disaster site, drawing cheers and applause from those awaiting the outcome of a continuing search-and-rescue operation for survivors of Wednesday's collapse.

Many of those killed were workers at clothing factories in the building, known as the Rana Plaza, and the collapse was the deadliest disaster to hit the garment industry in Bangladesh that is worth $20 billion annually and is a mainstay of the economy.

The fire that broke out late Sunday night sent smoke pouring from the piles of shattered concrete and halted some of the rescue efforts ? including a bid to free a woman who was found trapped in the rubble.

The blaze was caused by sparks as rescuers tried to cut through a steel rod to reach the woman, said a volunteer, Syed Al-Amin Roman. At least three rescuers were injured in the fire, he said. It forced them to retreat while firefighters frantically hosed down the flames.

Officials believe the fire is likely to have killed the trapped woman, said army spokesman Shahinul Islam. Rescue workers had delayed the use of heavy equipment for several hours in the hope that she could be extricated from the rubble first. But with the woman presumed dead, they began using heavy equipment around midnight.

An exhausted and disheveled Rana was brought before reporters briefly at the Dhaka headquarters of the commando team, the Rapid Action Battalion.

Wearing a printed shirt, Rana was sweating as two security officers held him by his arms. A security official helped him to drink water after he gestured he was thirsty. He did not speak during the 10-minute appearance, and he is likely to be handed over to police, who will have to charge him and produce him in court within 24 hours.

A small-time politician from the ruling Awami League party, Rana had been on the run since the building collapsed Wednesday. He last appeared in public Tuesday in front of the Rana Plaza after huge cracks appeared in the building. Witnesses said he assured tenants, including five garment factories, that the building was safe.

A bank and some shops on the first floor closed Wednesday after police ordered an evacuation, but managers of the garment factories on the upper floor told workers to continue their shifts.

Hours later, the Rana Plaza was reduced to rubble, crushing most victims under massive blocks of concrete.

Rana's arrest was ordered by Prime Minister Sheikh Hasina, who is also the Awami League leader.

On Saturday, police arrested three owners of two factories. Also detained were Rana's wife and two government engineers who were involved in giving approval for the building design. Local TV stations reported that the Bangladesh High Court has frozen the bank accounts of the owners of all five garment factories in the Rana Plaza.

Three floors of the eight-story building apparently were built illegally.

A garment manufacturers' group said the factories in the building employed 3,122 workers, but it was not clear how many were inside when it fell. About 2,500 survivors have been accounted for.

Army Maj. Gen. Chowdhury Hasan Suhrawardy, the coordinator of the rescue operations, said the next phase of the search involved the heavy equipment such as hydraulic cranes that were brought to the disaster site Sunday. Searchers had been manually shifting concrete blocks with the help of light equipment such as pickaxes and shovels, he said.

The work will be carried out carefully so as not to mutilate bodies, he said. "We have engaged many private sector companies which supplied us equipment, even some heavy ones," Suhrawardy said.

In a rare bit of good news, a female worker was pulled out alive Sunday. Rescuer Hasan Akbari said when he tried to extricate a man next to the woman, "he said his body was being torn apart. So I had to let go. But God willing, we will be able to rescue him with more help very soon."

The collapse and previous disasters in garment factories have focused attention on the poor working conditions of workers who toil for as little as $38 a month to produce clothing for top international brands.

The death toll surpassed a fire five months ago that killed 112 people and brought widespread pledges to improve worker-safety standards. But since then, very little has changed in Bangladesh.

Its garment industry was the third-largest in the world in 2011, after China and Italy, having grown rapidly in the past decade.

Among the garment makers in the building were Phantom Apparels, Phantom Tac, Ether Tex, New Wave Style and New Wave Bottoms. Altogether, they produced several million shirts, pants and other garments a year.

The New Wave companies, according to their website, make clothing for several major North American and European retailers.

Britain's Primark acknowledged it was using a factory in Rana Plaza, but many other retailers distanced themselves from the disaster, saying they were not involved with the factories at the time of the collapse or had not recently ordered garments from them.

Wal-Mart said none of its clothing had been authorized to be made in the facility, but it is investigating whether there was any unauthorized production.

So??I?ve arrived. Day 3 of being at the tower. Good thing they brought in a snow plow to clear the paths to the outhouse, storage sheds, and cabin. It would have been days of?shoveling. Day 1 of the fire season and I?m starting with a base of 36 cm of snow!

And guess what??It?s still snowing. I?ve been in a snow cloud now for a solid 24 hours and there doesn?t seem to be an end in sight. That?s not a bad thing necessarily. It?s giving me lots of time to ?settle? in. Unpack boxes and suitcases. Trying to find things, like where do they keep?batteries, the broom, and mop? This place has been shut up since last October so there?s a bit of cleaning to do. And I have nothing but time.

Lots and lots of time. Especially since the Internet (using an Aircard), isn?t nearly as good as I had hoped for. It doesn?t look like I?ll get as much use out of it as I had planned, except for the necessities (incredibly long loading times), like blog posts. That makes me a little sad. But I am in the middle of nowhere and should be grateful, after all, to have it in the first place. So, no more complaining from me.

I returned to the same tower I was at 4 and 5 years ago. What are the chances?

There are some good memories here and I keep finding evidence of my story, here and there. Antique salt and pepper shakers I brought with me the first year that I?d forgotten about. Small delicate glass shakers. So out of place in this rugged isolated place. A beautiful scented candle my best friend gave me years ago for my birthday (mostly used up, but with a little life left in it yet). The scent is Mediterranean Fig. An old apple basket I used to keep my onions and garlic in. Oh! And best of all, the tackiest clock you ever did see. Dusty blue in color, with a floral brocade background. Hideous, yet still hanging in the exact same spot. There?s a fondness for that hideous thing, for some reason or another.

This is an old cabin with plenty of character. Probably built in the 1970s, judging by the cupboards, wood paneling and the state of the floor. I better get my nostalgia in while I can. This ol? cabin is being ripped out next year and being replaced with a newer, ?better? version. I say ?better? since the new cabins are supposed to have very little storage in the kitchen and the bedroom closet has been replaced with an indoor shower. The shower sounds promising doesn?t it? Don?t get too excited, there?s still no running water, but it does provide a good place for a shower bag and protection from the bugs (priceless!). However, for a girl who loves food, cooking, and clothes, cupboard space and a closet are just as essential. I guess we?ll just have to wait and see.

As for the whole vegan thing, after three days, I feel a little hungry. I won?t lie.

If you?re wondering about a meat lover going vegan, I go into detail about it in?this post. But essentially I?m still a meat eater so if anyone wants to come by with some hunted meat or farm fresh eggs, I?m in. But finding sustainably raised meat around here would be next to impossible unless you were in tight with the locals. So I?m putting my values to the test. Can I do it? Probably, if I can figure the hunger part out.

On Day 1, I just unpacked. On Day 2, I made some soft vegan ?cheese? made of soaked cashews. Something I?ve been meaning to try. Wish I had done it earlier. Boy was I missing out. I actually have to refrain myself from eating it by the spoonful. I?ve also made some sprouted spelt and sesame bread and a couple extremely delicious meals.

Study: New bird flu jumped directly from chickens

LONDON (AP) ? Chinese scientists have for the first time found strong evidence of how humans became infected with a new strain of bird flu: from chickens at a live market.

Chinese scientists compared swabs from birds at markets in eastern China to virus samples from four patients who caught the new H7N9 virus. The scientists found the virus from one patient was nearly identical to one found in a chicken. The research was published online Thursday in the journal Lancet.

Finding definitive proof of how patients were infected is very difficult and experts have so far struggled to find much virus in birds. Despite taking nearly 48,000 samples from animals in live markets, Chinese officials found only 39 positive tests for H7N9. Experts had suspected birds in live markets to be the source of infection but weren't sure if other animals or wild birds might also be responsible.

Health officials have so far refrained from recommending any wide-scale slaughter of poultry to contain the disease, one of the main tools used previously to combat another bird flu strain, H5N1. Unlike that strain, H7N9 doesn't appear to sicken chickens, giving experts fewer signs as to where it might be spreading.

Chinese authorities have shut down live poultry markets in many affected regions, which seems to have slowed down the virus. Still, Taiwan reported its first case earlier this week.

So far, H7N9 has infected more than 100 people in China and killed more than 20.

Concerns about safety conditions in garment factories sourced by Western retailers were revived when a factory collapsed after serious cracks were found in the building yesterday.

But where would the money come from if she did not go to work? Taslima's mother asked her before heading off to work like normal.

This evening, Taslima is in tears, sitting by her mother?s body in a makeshift mortuary. Her mother was one of the more than 125 killed when the eight floor building collapsed on the outskirts of Bangladesh?s capital, Dhaka. Some 800 more were injured.?As search-and-rescue efforts continue, those numbers are likely to rise, say witnesses, who report that hundreds of people may still be trapped in the rubble.

An inspection team visited Rana Plaza, where the factory building is located in the suburb of Savar, the day before the collapse and asked the owner to keep the building closed after they identified cracks in it. That instruction, however, was ignored.

The incident is not an aberration for Bangladesh. It comes on the heels of a series of factory disasters, the latest just five months ago, when a fire ripped through the Tazreen factory in Dhaka while workers were trapped inside:?More than 100 died. The collapse?revives concerns about the poor working conditions, code violations, and garment owner negligence that has racked the world's second-largest garment-exporting country, where firms produce clothing for high-profile brands including Gap, H&M, and?Wal-Mart.?

?This is an example of the most irresponsible and insensible work by the authority,? says Selim Newaj Bhuiyan, former deputy director of Fire Service and Civil Defense. Mr. Bhuiyan has attended to some of the deadliest factory fires and collapses in Dhaka. ?When the building was warned, how could the authorities ask the workers to come to work?? he asks. Bhuiyan places the blame on building and factory authorities.

One worker at the factory, Sumi, described coming to work at 8:00 a.m., despite what she calls a subconscious fear in her mind.

When debris began falling from the ceiling of the fifth floor where she worked, it was already too late for her to escape. She was trapped inside along with hundreds of others as the floors collapsed one after another. Firefighters pulled her out five hours later. She was receiving treatment at a nearby hospital.

On the seventh floor, right after meeting with production managers and supervisors, Shariful Islam was returning to his work when suddenly he heard a loud noise.

?Immediately we fell several stories down faster than an elevator?s speed,? says Mr. Islam, a quality checker at New Wave Bottoms, one of the factories that rented the building (the others included New Wave Style, Ether Tex, and Canton Tech Apparel, according to CNN).

?I closed my eyes as the entire place was engulfed with dust. A stitching machine fell on my left leg,? says Islam, who later managed to escape the building with the help of two co-workers. ?All I could see were dead bodies all around me.?

Flouting standards

At least 630 people have died in more than 30 incidents since 1990, according to the Bangladesh Institute of Labor Studies.?Eight years ago, another factory collapse outside Dhaka killed about 70 workers.?In most cases factory owners have been identified flouting safety standards, but very few of them are brought to court.

Former President of the?Bangladesh Garment Manufacturers and Exporters Association (BGMEA)?Abdus Salam Murshedy told The Christian Science Monitor that since the Tazreen fire last November officials are working to inspect and identify the many buildings not up to code.

It takes time, he says, to look into the licenses of all of Bangladesh's factories.

According to a fact-finding report of Bangladeshi human rights organization Odhikar, the Chief Inspector of Bangladesh?s Factories and Establishment renewed Tazreen?s safety inspection without even visiting the premises. A token sum of money was enough for the factory authorities to ?get the application [for factory operations] approved on mobile phone,? according to Odhikar?s report.

?Only compensation [for the victims and their families] and mourning such incidents are not enough. There are many vulnerable factories that are not looked into,? says Babul Akhter, president of Bangladesh Garment and Industrial Workers? Federation. Mr. Akhter urges international buyers to be more cautious while placing orders to the suppliers and ensure that the suppliers comply with the standards.

Bangladesh?s garment industry, the second largest garment exporter in the world, makes up 80 percent of country?s export revenue. The garment sector earned $19 billion from exports in the financial year that ended in June 2012.

?We will investigate this incident jointly with the government and make it public,? says the current president of the BGMEA, Atiqul Islam.

Researchers identify key cellular organelle involved in gene silencing

RNA molecules, made from DNA, are best known for their role in protein production. MicroRNAs (miRNAs), however, are short (~22) nucleotide RNA sequences found in plants and animals that do not encode proteins but act in gene regulation and, in the process, impact almost all biological processes ? from development to physiology to stress response.

Present in almost in every cell, microRNAs are known to target tens to hundreds of genes each and to be able to repress, or "silence," their expression. What is less well understood is how exactly miRNAs repress target gene expression.

Now a team of scientists led by geneticists at the University of California, Riverside has conducted a study on plants (Arabidopsis) that shows that the site of action of the repression of target gene expression occurs on the endoplasmic reticulum (ER), a cellular organelle that is an interconnected network of membranes ? essentially, flattened sacs and branching tubules ? that extends like a flat balloon throughout the cytoplasm in plant and animal cells.

"Our study is the first to demonstrate that the ER is where miRNA-mediated translation repression occurs," said lead researcher Xuemei Chen, a professor of plant cell and molecular biology and a Howard Hughes Medical Institute-Gordon and Betty Moore Foundation Investigator. "To understand how microRNAs repress target gene expression, we first need to know where microRNAs act in the cell. Until now no one knew that membranes are essential for microRNA activity. Our work shows that an integral membrane protein, AMP1, is required for the miRNA-mediated target gene repression to be successful. As AMP1 has counterparts in animals, our findings in plants could have broader implications."

Study results appear today in the journal Cell.

Simply put, DNA makes RNA, and then RNA makes proteins. Specifically, RNA encodes genetic information that can be "translated" into the amino acid sequence of proteins. But noncoding RNAs ? RNAs that do not encode proteins ? are increasingly found to act in numerous biological processes. MicroRNAs are a class of noncoding RNAs whose main function is to downregulate gene expression.

Research on miRNAs has increased tremendously since they were first identified about 20 years ago. In the case of diseases, if some genes are up- or down-regulated, miRNAs can be used to change the expression of these genes to fight the diseases, thus showing therapeutic potential.

MicroRNAs are known to regulate target genes by two major modes of action: they either destabilize the target RNAs, leading to their degradation, or they do not impact the stability of the target RNAs, but simply prevent them from being translated into proteins ? a process known as translation inhibition. The end result of translation inhibition is that the genes do not get expressed. Just how miRNAs cause translational inhibition of their target genes is not well understood.

"We were surprised that the ER is required for the translational inhibition activity of miRNAs," Chen said. "This new knowledge will expedite our understanding of the mechanism of gene silencing. Basically, now we know where to look: the ER. We also suspect it is the rough ER portions that are involved."

Chen explained that the ER has two types: rough and smooth. Rough ER, which synthesizes and packages proteins, looks bumpy; smooth ER, which acts in lipid synthesis and protein secretion, resembles tubes. The ER protein AMP1, she said, is anchored in the rough ER.

"My lab has been conducting research on AMP1 for many years," she said. "And it's this protein that drew our attention to the ER. First, we realized that AMP1 is involved in miRNA-mediated translational inhibition. Then, since we already knew that AMP1 is localized in the rough ER, we shifted our focus to this organelle."

Next, her lab will attempt to crack the mechanism of miRNA-mediated translational inhibition. They will investigate, too, how miRNAs are recruited to the ER.

Family upset over Air Force officer's transfer

PHOENIX (AP) ? The Air Force's decision to transfer a lieutenant colonel to a Tucson military base after his sexual assault conviction was overturned by a commander has outraged the family of the woman who made the allegations, adding to the growing criticism of the military justice system.

The family says Lt. Col. James Wilkerson' transfer of to Davis-Monthan Air Force Base on the southern edge of Tucson is upsetting because roughly half the woman's family lives there. They're planning a protest Thursday outside the base.

The news comes amid a congressional uproar over the Wilkerson case, and follows heavy criticism of the military's handling of another case involving sex-crime allegations in California.

"They could send him to a number of places," said Stephen Hanks, an orthopedic surgeon in Tucson who is the brother of Wilkerson's accuser. "Why send him to a place where her family lives? It makes no sense."

The woman, a civilian employee who works with service members, accused Wilkerson of sexually assaulting her after a party at his house. Wilkerson and his wife denied the charges but said the woman stayed at their house that night.

A military jury in November convicted Wilkerson, a former inspector general at Aviano Air Base in Italy, of aggravated sexual assault and other charges. He was sentenced to one year in prison and dismissal from the service.

But a commander overturned the verdict and dismissed the charges, saying he found Wilkerson and his wife more believable than the alleged victim. Wilkerson already has reported for duty in southern Arizona, where he will work as a safety officer for the 12th Air Force.

Air Force spokesman Lt. Col. Brett Ashworth said military officials wouldn't have known about the woman's family in Tucson when Wilkerson's transfer was decided.

"His assignment was based on his qualifications and the needs of the Air Force," Ashworth said.

Wilkerson declined an interview request from The Associated Press.

The decision by Lt. Gen. Craig Franklin, commander of the 3rd Air Force at Ramstein Air Base in Germany, to overturn the verdict has been criticized by congressional leaders and advocates for confronting the problem of sexual assaults in the military.

The move led the Defense Department to propose that commanders be largely stripped of their ability to reverse criminal convictions of service members.

Under military law, a commander who convenes a court martial is known as the convening authority and has the discretion to reduce or set aside guilty verdicts and sentences, or to reverse a jury's verdict.

Protect Our Defenders, which advocates for military members who have been sexually assaulted, is calling for Defense Secretary Chuck Hagel to fire Franklin. The group's president, Nancy Parrish, said the Wilkerson case demonstrates that the military justice system needs to be changed.

Commanders who have broad authority in letting cases go forward face a conflict of interest, Parrish said.

"They are incentivized to sweep these cases under the rug. A commander's career is on the chopping block if a rape happens under his or her watch," said Parrish, whose group is pressing the Defense Department on behalf of Wilkerson's accuser.

The military justice system also came under heavy criticism in February, after a former soldier killed two police officers in California.

Records show the Army commander of the former soldier, Jeremy Goulet, allowed Goulet to resign from the military instead of facing a court-martial when he was twice accused of rape. The Army said a lack of evidence prevented it from prosecuting Goulet on charges dating back to 2006.

Critics say Goulet's case is as an example of what can go wrong when military cases are dropped.

Goulet shot and killed two detectives when they went to his house to question him about allegations that he was sexually inappropriate with a former co-worker. Goulet died in the Feb. 26 shootout with police in Santa Cruz, Calif.

Ashworth declined to comment on the group's call for Franklin to be fired. Franklin declined an interview request from the AP.

In a letter to a Pentagon official that surfaced earlier this month, Franklin said a combination of details led to his decision, including that the victim turned down offers to be driven home from the party, didn't accurately describe the house layout and gave a version of events that he didn't find credible. He said Wilkerson was a doting father with a good career, and it would be "incongruent" for him to leave his wife in bed, go downstairs and assault a sleeping woman he'd met earlier that evening.

Protect Our Defenders issued a response to Franklin's letter Tuesday, saying Franklin's account of the woman's options for rides home was inaccurate, Franklin showed blind loyalty toward the accused officer, and that the jury found the woman's story credible.

A family? can?t go back homes for months because there is raw sewage inside.? A mistake by Citizens Energy Group has now forced the family to scramble and try to find a new place to live.

?I opened up the bathroom door and the water was literally pulsating, coming up and coming down and splashing,? said homeowner Nikki McElhone.

?With such force it was actually hitting the ceiling,? said McElhone.

Nikki McElhone said it was one of the worst things that had ever happened to her.? Crews, cleaning out a sewer line, used too much pressure.

?As we understand it, water was applied to the sewer, then that water actually backed up into the lateral, which backed up into the home,? said Sarah Holsapple with Citizens Energy Group.

It was not just in the bathrooms either.? The sewer water seeped through the floor, and into the playroom.

?I did not know it hit the basement right away,? said McElhone.

The house has been cleaned once, but McElhone said it still stinks.

?The chemical they use, and just sewer water,? said McElhone.

Citizens Energy Group said it was their fault.? They said they would do what it takes to make it right, but three weeks later, the McElhone family was still staying in a hotel.

?State Farm at this point is getting hard to handle,? said McElhone.? ?They are telling me one thing, then they tell me I have to do something else.? Then they switch it and say, ?No.?? They give me deadlines.? Nobody even seems to care.?

Nikki and her husband Bryan have five children.? All five were premies, with delicate immune systems.? Two of those kids have special needs.?? The children went from having their own personalized rooms, to doubling up at the hotel with very little personal space.

?We cannot live like that,? said McElhone.? ?We go from 3,600 plus square feet into literally less than 500 square feet, with five kids.?

Nikki said she wants her family to be back in their house in the worst way, but it has to be safe enough first.

?For some reason my kids are very, very sensitive to all this stuff, now someone else has put it in my house,? said McElhone.? ?It is my home and somebody was able to go and blow it through the toilets and possibly get my family sick again.?

Citizen?s Energy Group said what happened to McElhone?s is rare.? It occurs at the most four times a year.? As for the family, they were being told it will be at least another five weeks before they can move back into their house.? They have to be out of their hotel by April 30.

?Potentially harmful substance? sent to U.S. military base

Authorities are investigating whether a poisonous substance was sent to a U.S. military base in Washington, D.C., Senate Majority Leader Harry Reid said Tuesday.

Reid told reporters that there was "an alleged ricin incident" at Joint Base Anacostia-Bolling, which serves the Navy and Air Force, and is located in the southeastern part of the city.

A spokesman for the Defense Intelligence Agency confirmed that a mail screening detected a "potentially harmful substance" at the base.

"This morning, DIA security personnel detected a potentially harmful substance during routine screening of incoming mail," DIA spokesman Lt. Col. Thomas F. Veale told Yahoo News in an emailed statement. "Tests by experts called in to assist indicate possible biological toxins. Prudent screening methods and force protection measures were implemented to prevent personnel from being harmed. DIA has maintained normal operations, and will not comment further on this event until an investigation is complete."

The news comes just days after letters were mailed to the offices of Mississippi Republican Sen. Roger Wicker, President Barack Obama and a Mississippi state judge that tested positive for the substance, which can be deadly if inhaled.

A suspect held in the investigations of the other ricin-laced letters, Paul Kevin Curtis, was released from custody earlier Tuesday. The investigation is still ongoing.

Police ID suspect in Illinois shootout that killed 5

MANCHESTER, Ill. (AP) ? The nephew of a small-town Illinois mayor shot and killed five people, including two boys, before leading police on a chase that ended in an exchange of gunfire that left him dead, authorities said Wednesday.

Illinois State Police said they believe Rick O. Smith, 43, entered the Manchester home through the back door and shot the victims at close range, leaving two women, one man and the boys dead. Two people were found in a bedroom, two in a second bedroom and the man in the hallway. A sixth victim, a 6-year-old girl, was injured and taken to a Springfield hospital.

"The offender took the 6-year-old out of the residence and put her in the hands of a neighbor," State Police Lt. Col. Todd Kilby said.

Officials have not revealed a motive for the killings. Police said the victims are related and they believe Smith and the victims were acquainted but they didn't provide details of the relationships.

A bystander called police and told them that Smith fled the home in a white sedan. A car chase ensued, leading authorities to the nearby town of Winchester, where Smith and officers exchanged gunfire. Officers shot Smith, and he later died at a hospital.

Police said they found a rifle, shotgun and large hunting knife in Smith's car.

Coroner officials said they plan autopsies on the victims Thursday morning in Bloomington and identities would be released at that time.

Scott County State's Attorney Michael Hill said Smith, of rural Morgan County, had previous convictions for reckless homicide, drugs and bad checks.

Manchester Mayor Ronald Drake confirmed that Smith was his nephew, saying he hadn't spoken to Smith in two years, but he believed his nephew was unemployed. Drake said the last time Smith contacted him was to borrow tools.

In Manchester, yellow police tape surrounded the small one-story brick home where the victims were found. Manchester is a village of about 300 residents located about 50 miles west of Springfield.

"It's a close-knit community," Drake said. "Everybody talks to everybody. ... We enjoy that goes on (in) town. This is just a tragedy for (the) whole town."

Manchester resident Julie Hardwick, 48, said she lives in the same county housing authority complex as the victims. Authorities told her she couldn't return to her home yet because of the investigation, she said.

"The kids were really nice," Hardwick said of the family. "You couldn't ask for better kids."

The Rev. Robin Lyons of Manchester United Methodist Church, one of two churches in the community said, "this shows tragedy can happen anywhere."

Two area school superintendents said they received calls from county sheriffs before 6 a.m. informing them that five people had been shot to death at a house in Manchester and that a suspect was at large.

Superintendent David Roberts of the Winchester School District and Les Stevens of the North Greene Unit District No. 3 both said they immediately canceled classes when they were told of the shootings and that other school districts did the same.

Roberts said the wounded girl is a student at Winchester Grade School and her teacher was with her at the Springfield hospital.

The school will use its own counselor, nurse and other staff members to help students who need to talk, Roberts said. Other area districts have offered to help too.

Roberts said he also will call on area ministers to be available on campus. "I've found that to be helpful in the past," he said.
